Terms of Service

1. What GETVIRAL is

GETVIRAL (app.getvir.al, getvir.al, *.getvir.al) is a platform operated by GETVIRAL, Tirana, Albania that connects businesses established in Albania with content creators (influencers) and singers from Albania and Kosovo. Businesses publish products and set a commission for every unit sold. Influencers pick products and promote them through a dedicated link. When a customer buys through that link, the sale is attributed to the influencer. Businesses and singers can also open campaigns in which influencers are rewarded according to the views of their posts. Influencers can also sell a business the right to use in its advertising the videos they made for its products.

GETVIRAL is only an intermediary platform and is not a party to the sale. The seller of the product is the business, which manages and bears sole responsibility for everything towards its customers: the product and its quality, delivery problems, refusals, returns, exchanges, complaints, warranties and refunds, and the fulfilment of its legal obligations towards the customer. By creating an account or placing an order you accept these terms.

2. Accounts and verification

  • Registration requires truthful information and an email address you control. The email must be verified before the first sign-in.
  • Influencers prove that the TikTok or Instagram account they use is their own by connecting it through the platform's official login ("Continue with TikTok" or "Continue with Instagram"), which verifies the account at once, because only the account owner can grant this access. The same person may use the same connected account for their profile, for the viral-video panel and for the singers' campaigns, or a different account in each. An account already connected by another person on GETVIRAL cannot be connected. We never ask for your TikTok or Instagram password.
  • One person or business keeps a single account. Duplicate accounts may be blocked.
  • After several consecutive failed attempts from the same network, sign-in from that network is temporarily blocked and the wait grows with every further failure. When failed attempts for the same account come from many networks within one hour, password sign-in may also be temporarily blocked from other networks. A device where you have signed in successfully before can always try within its own limit. The block expires on its own. The block on a network is lifted upon the first correct sign-in from that network, and the block on the whole account is lifted upon the first correct sign-in from any network. Resetting the password with the emailed code or link counts as a correct sign-in. The account is never closed for this.
  • You are responsible for keeping your password confidential and for every action taken from your account.

3. Connected TikTok and Instagram accounts

Connecting a TikTok or Instagram account to GETVIRAL is voluntary. It happens on the platform's own login screen, where you see and approve the permissions we request.

  • GETVIRAL receives data from TikTok and Instagram ONLY through their official APIs (TikTok Login Kit and the TikTok API, Instagram API with Instagram Login), only for the account you connected and only with your authorisation. We never read TikTok or Instagram pages automatically (no scraping, no bots, no automated scripts), and we never ask for or see your password. We make no request to any TikTok or Instagram address outside these APIs: for this reason a TikTok short link (vm.tiktok.com/…) is not accepted when you submit a post. Paste the full link of the video (tiktok.com/@name/video/…) or, with your TikTok account connected, choose the video from the list of your own TikTok videos.
  • On TikTok any account can be connected. On Instagram only professional accounts (Creator or Business) can be connected, because Meta's API works only with them. Switching a personal account to Creator is free, takes about a minute and makes the account public.
  • A TikTok or Instagram account can be connected to only one GETVIRAL account. If you switch off one of the permissions we request, the connection is refused and nothing is stored. The screen tells you which permission to leave on.
  • Access is read-only: GETVIRAL never posts, comments, sends messages, follows anyone or changes anything on your accounts.
  • We use the connection only to: confirm that the account is yours (and, when you verify your profile with it, show its username as verified on your public page), read your official follower count (for the free-subscription threshold and the check of unusual view counts), read, for the posts you submit to campaigns, whether they are yours, whether they still exist, when they were published, on TikTok whether the caption contains the campaign hashtags, and their statistics, which set your reward and are shown to you in your panel, and, only when you ask for it, show you the list of your recent TikTok videos so that you can choose the one you submit. The exact list of data is in the Privacy Policy.
  • You can disconnect at any time from your panel: an account used in the viral-video panel or in the singers' campaigns is disconnected there, and an account you verified your profile with that no section uses (it only keeps your profile's follower count up to date) is disconnected in "My profile". Once the account is no longer used in any section of your panel, we delete its access tokens and profile data at once and, for TikTok, we also revoke GETVIRAL's access at TikTok. An account that no section of your panel uses any longer and that is not your profile's account, for example the old account of a section where you connected another one, is deleted automatically in the same way. If you revoke access from the TikTok settings, or TikTok ends it, we delete the tokens as soon as we learn of it, mark the connection as needing to be reconnected and notify you. The same happens when Meta ends our access to an Instagram account for another reason (for example the token expired). A connection that is not reconnected within 90 days is deleted automatically. If you remove GETVIRAL from the Instagram settings, Meta notifies us and we delete the connection at once and notify you. Whenever an Instagram connection is deleted, the Instagram data of your campaign posts are deleted with it, except the view count counted for each reward and the amounts (details in the Privacy Policy). Until you reconnect, we cannot read your posts' statistics automatically and staff check your campaign posts instead.
  • GETVIRAL is an independent service and is not affiliated with, endorsed or sponsored by TikTok or Meta. TikTok and Instagram remain subject to their own terms and community guidelines, which you must also follow.

4. For businesses

  • Only businesses established in Albania can register. For now, businesses from Kosovo cannot take part (influencers and singers from Kosovo can).
  • Every business gives its NIPT or, if it has no NIPT, an identity document (ID card or passport) of the person who manages the business on GETVIRAL. The business also gives this document when its NIPT is not found in the QKB register or when it says that the official name in the QKB is not its own, so that staff can check the NIPT by hand. The document is used only to verify who manages the business: only GETVIRAL staff see it, it is stored privately while the account is active and deleted when the account is closed. A business that sells physical products also gives the business address (street and city), from where the orders are shipped.
  • When a business gives or changes its NIPT, GETVIRAL checks it automatically in the public register of the National Business Center (QKB): whether it exists, whether it is active, its official name, its trade names, its legal form, its city and its registration date. When the name the business chose on GETVIRAL matches neither the official name nor a trade name in the QKB, the business is asked whether the official name is the name of its business. GETVIRAL also compares the first and last name of the person who opens the account with the names of the administrators, partners and shareholders registered in the QKB. These names are compared only at the moment of the check and are never stored: only a yes or no answer is kept. This check proves only that the business exists and is active, not that the account belongs to that business. A NIPT that has received invoices cannot be removed or changed while the business has unpaid invoices or its account is closed for obligations, and every invoice keeps the official name and NIPT it was issued to.
  • The NIPT of a verified business is checked again in the QKB register once a year.
  • When a check made after the NIPT was saved does not find it in the QKB, GETVIRAL asks the business, with a notification in its panel and by email, for the identity document of the person who manages the business on GETVIRAL, so that staff can check the NIPT by hand. The request stays in the panel until the document is uploaded, the NIPT is changed or staff verify the business. This never stops the business.
  • Businesses verified automatically through the QKB are also reviewed by GETVIRAL staff, who may ask for proof of representation.
  • The official name in the QKB is used on invoices and in the contract. Customers and influencers see the name the business chose on GETVIRAL.
  • The check never stops the business's work: its products and campaigns continue normally, whatever the result. When the business cannot be confirmed automatically, GETVIRAL staff check its data, for example when the NIPT is not found in the QKB or is not active, when the business says that the official name is not its own, when the name of the person who opens the account does not match any administrator, partner or shareholder registered in the QKB, or when the business has no NIPT. When the name of the person does not match, GETVIRAL asks the business, with a notification in its panel, for the identity document of an administrator of the business registered in the QKB and, when the person who manages the account is not an administrator, for that administrator's written authorisation, and staff check the document. The business is notified as soon as staff verify it. When the QKB register does not respond, the check is repeated automatically later. The NIPTs given before this check existed are checked once in the background, and staff may repeat a check by hand. When a later check finds something that was not there before (for example the NIPT is no longer active or the name of the person does not match), the verification mark is removed and GETVIRAL staff review the business again. This never stops anything.
  • Whoever registers a business declares that they have the right to represent it. GETVIRAL may ask for proof of this at any time: the identity document of an administrator of the business registered in the QKB, or their written authorisation.
  • This information must be truthful, belong to the business and be kept up to date. False information, or information of another person, leads to the closure of the account. Whoever registers a business they do not represent is liable for the damage caused to the real business, to customers and to GETVIRAL, and the account is closed. The business's tax and legal obligations are its own.
  • Product information (price, description, photos and videos) must be truthful and kept up to date.
  • Products must not belong to the prohibited categories (section 12). Staff remove any product in them. A product whose title, description or variants contain words linked to these categories is saved inactive and waits for staff review. Staff approve it, and it becomes public, or remove it with a reason. Until the decision, the business cannot activate it. If the business edits a product removed by staff, it goes back to review and is not activated automatically.
  • The 'What was it?' price must be the real price at which the product was previously sold. An inflated or invented old price is removed from the platform and repeat violations may lead to removal of the product.
  • Orders are delivered only within Albania, by the courier Ultra (U-CEP), and there is no cross-border shipping fee. The business includes the shipping cost in the product price, so shipping is free for the customer. The amount the customer pays on delivery belongs to the business and Ultra hands it directly to the business, under the business's own contract with Ultra. GETVIRAL does not collect or hold this amount.
  • Every platform order is shipped ONLY with Ultra, with the business's own Ultra account and contract. The business opens its Ultra account itself and creates the parcel there itself. GETVIRAL does not open Ultra accounts for businesses, does not create shipments on their behalf and is not a party to the business's relationship with Ultra. Shipping a platform order with another courier, by hand or outside the platform is prohibited. The tracking number that Ultra gives for the parcel is entered in the platform within 3 days (72 hours) of the order and is verified on Ultra's public tracking page. If the tracking number cannot be verified for technical reasons, the business writes to support@getvir.al and follows the team's instructions, still without using another courier.
  • A tracking number is not accepted, when it is entered or when the order is rejected, if Ultra's tracking page shows that the parcel was created more than 15 minutes before the order or if the same number is already entered on a still open order of another business.
  • The order status (Accepted or Rejected) must be updated within 72 hours of entering the tracking number. When the customer refuses or does not collect the parcel, the business marks the order Rejected within this deadline, and no commission is invoiced. At the moment of a rejection the tracking number is verified on Ultra's public tracking page, and a number that cannot be found does not allow the rejection. When this check cannot be made at that moment, because the reading limits for Ultra's page have been reached or Ultra has asked for a pause, the rejection is not recorded and the business tries again after the time it is shown, within the deadline. The same applies when the tracking number is entered. This wait does not extend the deadlines for the status and the tracking number. The customer is notified by email, within the daily email limit, when an order is rejected or cancelled.
  • The 'Rejected' status is only allowed for orders that have an Ultra tracking number entered, so the customer's refusal can be verified on Ultra's tracking page.
  • GETVIRAL follows every parcel itself on the public tracking page of the courier Ultra (u-cep.com), with the tracking number entered by the business, several times a day until the order is decided. When the page shows Delivered (Dorëzuar), the order is marked Accepted automatically and the influencer's commission becomes active. When the page shows Refused (Refuzuar) or that the parcel was returned, the order is marked Rejected automatically and no commission is invoiced. The business can still update the status itself within the deadline.
  • The order is not marked automatically, and the business updates the status, when the page does not respond or shows an unclear state, when the city shown by the page does not match the city of the order, when the same tracking number is also on another order outside the same parcel, when the parcel or its last update at Ultra is more than 15 minutes before the order, or when the parcel's reference at Ultra is the code of another order. The order is not marked Rejected automatically when the page already showed Refused when the number was entered, or when Ultra shows the refusal after the status deadline. GETVIRAL staff may review these cases.
  • When Ultra's tracking page shows Delivered, the order cannot be marked Rejected. An order that is already accepted, rejected or cancelled is not changed by reading this page.
  • If the status is not updated within the deadline, the order is automatically marked ACCEPTED and the commission is invoiced. If the tracking number is not entered within 3 days (72 hours) of the order, it is no longer accepted and the order can no longer be rejected: it is automatically marked ACCEPTED 5 days (120 hours) after it was created, and the influencer's commission becomes active and is invoiced.
  • An order you believe to be fake or abusive must be reported through the platform (complaint on the order) before the deadline. GETVIRAL reviews it and may cancel it. While your complaint is open, the order is not accepted automatically after the deadline and its commission is not invoiced. If GETVIRAL cancels it, no commission is charged. If not, the order is accepted when the review is closed. If during the review you mark it Accepted yourself, or Ultra's tracking page shows Delivered, the order is accepted at that moment. In every case the acceptance is dated when it happens and the commission enters the next invoice.
  • Customers may write to you through the platform chat before ordering. Communication with them stays INSIDE the platform. Diverting them to external channels (Instagram, WhatsApp, Viber, etc.) is prohibited. Every chat on the platform is filtered automatically for attempts to move the contact outside, and GETVIRAL staff read a conversation only when a message is flagged by the filter, reported or part of a complaint, with every such access recorded. An attempt confirmed by staff lowers the Trust score by 1.0, and you may appeal to ankesa@getvir.al within 7 days.
  • Businesses without physical products may register for promotion campaigns only (services, events, announcements). They can enable physical products later from the profile, by giving the business address from where the orders are shipped and signing the contract for businesses that sell products. This change is irreversible and the account cannot return to campaigns-only. Singer accounts cannot sell physical products.
  • The business alone manages and answers for every issue with its customers: the product and its quality, delivery problems, refusals, returns, exchanges, complaints, warranties and refunds. GETVIRAL only intermediates and is not a party to the sale (section 21).

SALES FEE AND PRODUCT LIMIT

  • Registration and product listing are FREE: there is no monthly subscription and there are no plans.
  • The first 3 months from business registration are completely free: no platform fee on sales, no matter how many orders you receive.
  • A NIPT receives the free months only once. When an account gives a NIPT that another GETVIRAL account has already used, its free months are counted from the first registration with that NIPT.
  • After 3 months: 50 ALL (or 0.5 €) for every accepted order.
  • ONLY accepted orders are counted, by the date they were accepted. Rejected orders and orders not picked up by the customer are not charged.
  • Each currency is accounted for separately, with no conversions.
  • The commission the business sets for the influencer must be at least 10% of the product price.
  • The number of products has a technical limit. When you reach it, contact support from your panel to raise it.

5. For influencers

  • The subscription is free if you have at least 1000 genuine followers on TikTok or Instagram (one network is enough). The number used is the official follower count of the account you registered and verified with: the one returned by the platform's official API, refreshed daily.
  • Below this threshold the fee is 1000 ALL/month, payable in advance. It is removed automatically as soon as the account you registered and verified with reaches the threshold, and it is not reinstated when that same account's followers drop. Accounts connected only for campaigns do not waive the fee. If you remove or replace the account that made your subscription free and none of your remaining verified accounts reaches the threshold, the fee is reinstated, with notice and a 5-day grace period.
  • If the subscription is not renewed, you have a 5-day grace period. After that your links are deactivated and customers can no longer order through them.
  • While card payment is not open for your account, the subscription is suspended: the fee is not requested and your links are not deactivated until card payment opens.
  • The subscription can be renewed in advance, for the following month only: the paid month is added after the current expiry date, so no days are lost.
  • If your subscription becomes free while a month paid in advance is still unused, that month is not refunded and is not converted into credit.
  • Only influencers with a verified profile and a signed influencer contract may take part in campaigns.
  • Connecting your TikTok or Instagram account is voluntary (section 3). Every post you submit to a campaign is checked automatically through the official API before it can earn a reward, and GETVIRAL staff review the posts that are flagged or that have a complaint (section 13).
  • You must comply with the terms and community guidelines of TikTok and Instagram, including disclosing paid content with their official tools (section 10).
  • Creating fictitious orders — by yourself, relatives or third parties — is prohibited.
  • Buying followers, views, likes or comments, or inflating them through automated accounts, is prohibited.
  • Promotion must be honest: no false promises and no untrue claims about the product.
  • You have no access to customers' personal data: you only see the product, the status and the tracking number.
  • Your commission stays pending until the order is decided. It becomes active when the order is accepted (by the business, automatically when Ultra's tracking page shows Delivered and the checks described for businesses pass, or automatically after the deadline) and is cancelled when the order is rejected, also automatically when the page shows Refused or that the parcel was returned. If you believe there is a mistake, file a complaint on the order.
  • Orders are delivered only within Albania: for now customers cannot order through your links for delivery to Kosovo. Influencers from Kosovo take part in the platform in the same way.
  • Your public page (your shop) also opens at its own address, <name>.getvir.al. GETVIRAL first proposes an address from your verified TikTok or Instagram username, or from your code, and you can change it under My profile. The name has 3 to 20 letters, only a-z, with no digits, punctuation marks or spaces, and must be free. Capital letters become lowercase automatically.
  • The <name>.getvir.al address is provided by GETVIRAL and remains the property of the platform. It is given to you for use while your account is active, it cannot be sold or transferred to others, and it gives you no right over the name or over the getvir.al domain.
  • You can change the address once every 30 days: after you save a new address, you cannot change it again for 30 days. After each change the old address stays reserved for you for 30 days and takes visitors to the new one, then it is released and someone else may take it, so update the link in your bio right away. Old app.getvir.al/@code links keep working and take visitors to your address.
  • GETVIRAL may refuse or remove an address that impersonates a person, a brand, a business or GETVIRAL itself, that is offensive or misleading, that infringes the rights of others or that is used for abuse. Names reserved for the platform are not given out. After a removal, links with the removed address no longer open, your links under My links return to the app.getvir.al/@code address and you can choose another address. When an address is removed for impersonation or abuse, the name may be blocked permanently.
  • While your account is blocked or its closure is being processed, the address stays with your account and the shop does not open at it. When your account is permanently deleted, the address is released and stays reserved for 30 days without taking visitors anywhere, so that nobody else can take it immediately.

6. Commissions and payments

GETVIRAL keeps 25% of the commission of every confirmed sale. The influencer receives the remainder. When an influencer reaches 30+ accepted orders in a payout period (from the 25th of the previous month to the 24th, orders in lek and in euro counted together), the platform fee drops to 20% for that period. Commissions are displayed gross across the platform, while the EARNINGS panel also shows the net amount. From the rewards of business and singer campaigns GETVIRAL always keeps 25% (the reduction to 20% applies only to sales commissions). The influencer receives 75%. Campaign reward tiers are shown gross. The EARNINGS panel also shows the net amount.

BILLING PERIOD

  • The business is invoiced every 2 weeks: commissions of the 1st–14th are invoiced on the 15th of the month, commissions from the 15th to the end of the month are invoiced on the 1st of the following month.
  • The invoice of the 1st also includes the sales fee for the month just closed (once per month).
  • Every invoice is payable within 5 days of generation (the 15th–19th and the 1st–5th respectively).
  • Every invoice is paid in full: partial payments are not accepted. On the last day of the deadline we send a reminder. After the 5-day deadline passes without payment, the business profile and its products become UNAVAILABLE until the balance is settled: the panel is closed completely (no action on products, through the app or otherwise) except the obligations page and the contract, and the Trust score is lowered by 0.5 once per block.
  • Influencers are paid between the 1st and the 5th of the month for the period from the 25th of the previous month to the 24th (monthly cycle). Campaign rewards are included in the payout that follows the payout period (25th–24th) in which the reward tier was reached, without waiting for the campaign to close, once the post has been confirmed to have stayed public for 7 days and there is no open complaint about the influencer's posts in that campaign (section 13). If that happens later, the reward is included in the first payout after it. The rewards of a campaign whose payment was reversed to the card (refunded or disputed with the bank), or that was paid with credit arising from such a payment, are held until the GETVIRAL team decides.
  • Earnings from video sales (section 9) are paid in lek with the first monthly payout made at least 8 days after the business paid, once the 7-day report period has closed, and only when no report about the sale is open. A sale paid in the last days of a payout period is therefore paid with the following payout. When staff decide a report later, the earning is included in the first payout after the decision.
  • Payout is made once earnings reach at least 5000 ALL or 50 € gross. Below this amount, earnings carry over automatically to the next month.
  • Each currency has its own ledger: invoices and payouts in lek and in euro are kept separate, with no conversions between them.
  • Payout is made to the payment details declared in the profile (an Albanian or Kosovo IBAN). Without complete details, the payout is postponed until they are provided.
  • For your security, after the payment details are saved or changed, no payout is made to them for 72 hours. During this time you receive a notification in your panel and, within the daily email limit, an email about the change, so you can stop a change you did not make. A payout that falls within this time is made right after it.

PAYMENT METHODS

  • Business invoices and campaign budgets can be paid by bank transfer, according to the details the GETVIRAL team sends you, or, where offered, by card through the payment provider POK (pokpay.io).
  • The influencer subscription is paid ONLY by card through POK: the PAY button in your panel takes you directly to POK's payment page. Bank transfer is not available for the subscription.
  • Video purchases and their renewals (section 9) are paid ONLY by card through POK.
  • Card details are entered ONLY on POK's secure payment page. GETVIRAL never sees and never stores your card data.
  • The amount charged to the card is exactly the amount of the obligation, in its own currency, with no additional fees from GETVIRAL.
  • An obligation paid by card is marked as paid automatically as soon as POK confirms the payment. An obligation paid by bank transfer is marked as paid once the GETVIRAL team confirms that the transfer has arrived.
  • Refunds of card payments, where they are due (for example a duplicate payment), are made through the same provider, to the card that was used, within 10 working days of your request at support@getvir.al.
  • If a card payment is reversed (refunded through POK or disputed with your bank), what it paid for is reversed as well: the invoice becomes unpaid again (and the business profile becomes UNAVAILABLE if the deadline has passed), the subscription loses the paid month, the video licence is cancelled, and the campaign is stopped, the credit that arose from it is cancelled together with any credit that arose again from it, and the rewards of its influencers and of campaigns paid with that credit are held until the GETVIRAL team decides. No credit arises any more from the money of a reversed payment, not even when an amount is later released by a rejected post. Card payments made in POK's test environment before launch are not real money: they create no real credit, and the rewards of campaigns paid that way are never paid out.

7. Orders and customers

Orders are placed with cash on delivery and delivered only to addresses in Albania, by the courier Ultra. For now we do not deliver to Kosovo: an order with a delivery address in Kosovo is not accepted. Shipping is included in the price, with no separate fee. The order stays in the currency of the product's price. Customer data (name, phone, address, city and notes for the courier) is used only to fulfil the order: it is shown only to the selling business and the platform administrator. The business gives Ultra only what the delivery and the collection of the payment need. GETVIRAL sends Ultra no customer data. The customer's email is used only by the platform for the order confirmation and the tracking link. It is not shown to the business or the influencer, it is not given to Ultra and it is not used for advertising. The influencer sees only the parcel's tracking number and the shipment status, never the customer's name, phone, address or email. Ultra's public tracking page, which opens with the tracking number, may show the city and postal code of the delivery. Orders are subject to reasonable limits per device and phone number to prevent automated or fraudulent ordering.

8. Viral video campaigns

Businesses can open promotion campaigns (events, announcements, services) where influencers are rewarded according to the views their posts achieve. The business pays only the campaign budget, with no additional fee: the reward tiers it sets are gross amounts, and GETVIRAL keeps 25% of every reward paid out of that budget, while the influencer receives 75%.

CATEGORY, PAYMENT AND CONFIRMATION

  • Every campaign has a category, chosen from the list on the campaign form. A singer's campaign is always in the "Music and songs" category. "Other" requires a description, and staff decide whether it is allowed. Campaigns in the prohibited categories (section 12) are not allowed.
  • Every campaign is paid first and then confirmed by GETVIRAL staff before it becomes public. After creation the campaign is "Awaiting payment": you pay the budget from its page. Once the payment is confirmed, or when your credit covers the whole budget, the campaign is "Awaiting confirmation": staff check its instructions and hashtags, together with its category and description for a business campaign, or the song and its sound for a singer's campaign. If staff confirm it, the campaign becomes public and its deadline starts from that moment. If they do not confirm it, you are told the reason, the credit it used is returned to you and the amount you paid in money is kept as credit, valid 6 months from the decision, under the same rules as any other credit. A paid campaign cannot be cancelled by you: staff decide. Staff confirm within 24 hours at most. A campaign that is not paid within 24 hours of its creation is cancelled automatically and the credit it used is returned.
  • Influencers are notified of a campaign, and can take part in it, only once it becomes active, and only with a verified profile and the signed contract.

BUDGET AND DEADLINE

  • The campaign budget is PREPAID right after the campaign is created, from its page, before staff confirm it: the campaign becomes public only after GETVIRAL staff confirm it, once the budget payment is confirmed or when your credit covers the whole budget. The minimum budget is 30 000 ALL or 300 € (each currency separate, no conversions).
  • GETVIRAL holds the budget and distributes it to influencers who reach the thresholds. You set the deadline when you create the campaign, from 14 to 90 days, and it cannot be shortened afterwards: the campaign closes only when its deadline passes or when the whole budget has been distributed. Neither the business nor the singer can close a published campaign early, so that influencers who have started producing a video have the time to post it.
  • After the deadline no new posts are accepted. The closing is completed, and the unspent budget becomes credit, once the final reading of views has been made (section 13) and staff have decided on every post flagged for review, submitted before the deadline: a post that was still awaiting review at the deadline does not lose its reward because of the time staff took to review it. An open complaint does not stop the closing: staff decide on it afterwards, and if it is upheld, the amount becomes credit.
  • The unspent portion of the budget is NOT refunded in money: it is credited to your GETVIRAL account, and on the form of a new campaign you can choose to deduct it from that campaign's budget. By publishing a campaign you accept this condition. The credit is valid for 6 months from the closing of the campaign that generated it, is kept separately per currency (lek and euro are never converted into one another), is usable only for new campaigns — not for any other fee or obligation — and is not transferable to another account. Any part left unused when the 6 months expire is forfeited. We notify you 14 days before, and then every 3 days, in the app and by email. The amount of a post rejected after the campaign closed returns to the credit that paid for the campaign, with its original expiry date, and only the part paid in money becomes new 6-month credit.
  • Credit used in a campaign keeps its own expiry date: if that campaign closes with an unspent budget, the part that came from credit is credited back with the ORIGINAL expiry date, and only the part paid in money receives a new period of 6 months. The expiry date of a credit cannot be extended by opening and closing campaigns.
  • If staff do not confirm a campaign, or you cancel it before paying it, the credit it used is returned to you. The time the campaign waited for staff confirmation, from the payment or from creation when credit covered the whole budget, does not count against that credit: a part whose expiry date passed during that wait is returned as new credit whose expiry is extended by the time of the wait. The time a campaign waits for your payment is not added.

REWARDS

  • The business or singer defines the reward tiers by views (gross amounts) and a maximum budget. Each influencer is paid for ONE video only: the one that reaches the highest tier among their videos in that campaign by the final reading of views after the deadline (section 13).
  • The amount is reserved for the influencer the moment their video, approved automatically or by staff, reaches a view threshold. When one of their videos later reaches a higher tier, only the difference is reserved. When reserved amounts reach the budget, the campaign closes to new posts.
  • Each influencer may submit up to 3 videos per campaign on each of the campaign's networks, so that they can try again with an improved video. In a campaign on both networks, TikTok and Instagram are measured separately: each link counts with its own views and the best result counts. A campaign cannot be restricted by follower count: any verified influencer may take part.

SINGERS AND MUSIC

  • Singers can also open campaigns for their own songs and sounds (TikTok and Instagram only), under the same prepayment, confirmation and minimum-budget rules and the same split of every reward (25% GETVIRAL, 75% influencer).
  • By publishing a campaign, the singer declares that they own or control all the rights needed to use the song or sound in paid (branded) content, those of the authors of the lyrics and music, of the producer, of the label and of the digital distributor, or that they have obtained written permission from them for this use, and grants the participating influencers a free, non-exclusive licence to use it in their campaign posts on TikTok and Instagram, including commercial use with the "Paid partnership" label, for as long as those posts remain published. Any third-party claim over the rights is the singer's sole responsibility.
  • On TikTok, when the song is not in TikTok's Commercial Music Library, the influencer who posts with "Branded content" turned on accepts TikTok's "Music Usage Confirmation", confirming that the music licences have been obtained: that confirmation relies on the singer's declaration and licence above. On Instagram, the song is used as the video's original audio, not from Instagram's music library (which is for non-commercial use only), and Meta may mute the audio or change its attribution when it matches a licensed song in its systems.

9. Selling and buying influencer videos

Influencers can sell to a business the right to use, in the business's own advertising, the videos they have posted on TikTok or Instagram for that business's products in their shop. GETVIRAL keeps 20% of every sale and renewal, and the influencer receives 80%.

FOR INFLUENCERS

  • Only influencers with a verified profile and a signed influencer contract can sell videos. In "Sell your videos" the influencer adds, under each product currently in their shop, the links of the videos they posted for it, up to 5 per product. A video can be offered only once on the platform and only for one product. When someone else has submitted it without proof, the influencer whose connected account proves the video takes it over. A rejected video, including one removed after an accepted report, cannot be offered again by the same influencer.
  • The video must belong to the influencer's own account. It is verified through the official TikTok or Instagram API, with the account connected for the viral-video panel (section 3). When the API cannot verify it (an account that is not connected, an API that does not respond), GETVIRAL staff check the video and accept it or reject it with a stated reason.
  • The influencer also uploads the original file of the video, up to 90 seconds and 250 MB, without the TikTok logo and without music from the TikTok or Instagram library, which may not be used in advertising. It must be the same video as the one posted: when TikTok gives us the duration of the post, a file that differs from it by more than 2 seconds is rejected and deleted automatically. A file uploaded again over the first one is rejected too, and the influencer uploads it from the start.
  • A video is shown only to the business that owns the product, with the influencer's name, photo and level, once it has been verified and its file is ready, after a last check of the file on the video server within about 2 hours of the upload, and only while the product is in the influencer's shop and the influencer's account is not blocked. The business watches the posted video inside the app and is notified of every new video. A copy of the video file is given only to the business that buys it.
  • A file that is no longer on the video server, was replaced after the upload, or is not processed within 24 hours after the upload window is rejected, and the influencer can upload it again.
  • The price depends on the influencer's level, which grows with the videos they sell: RISING STAR for the 1st to the 20th video sold (2000 ALL), VIRAL for the 21st to the 50th (4000 ALL), ICON from the 51st onwards (6000 ALL). The business pays the price of the level the influencer has at the moment of purchase. Only paid purchases count towards the level, at most 3 from the same business. Purchases by a business registered from the same device as the influencer, or from the same device as another buying business that already counts, do not count. Renewals do not count. The level of a verified influencer, only its name and never the number of videos sold, is also shown on the influencer's public page.
  • The influencer's 80% shows as active in EARNINGS at once and is paid in lek with the monthly payout once the 7-day report period has closed (section 6), together with the other earnings and counting towards the minimum payout. Exception: from the moment the influencer requests the closure of their account, or GETVIRAL deletes their account, their share of every renewal, and of a purchase paid after that moment, belongs to GETVIRAL.
  • A sold video cannot be withdrawn by the influencer, so that the business can renew its licence, nor can a video while a business is paying for it. When the influencer requests the closure of their account, their videos can no longer be bought by new businesses, and with the final deletion they are withdrawn from sale and the unsold files are deleted. Businesses that have already bought a video can renew their licence after the request and after the deletion, under the same terms: after the final deletion only before their licence expires. From the moment of the request, the influencer's share of every renewal, and of a purchase paid after the request, belongs to GETVIRAL. The file of a sold video is kept while a business holds a valid licence and is deleted once the last licence expires.
  • A rejected video stays in the influencer's list with the reason and cannot be withdrawn or offered again by the same influencer.
  • By offering a video, the influencer declares that they created it, that every person who appears in it has given their consent and that it contains no music, photos, videos or brands of others without permission, apart from the business's product. Any third-party claim over the video is the influencer's responsibility. Selling to the business outside the platform the right to use a video offered on GETVIRAL is prohibited.

FOR BUSINESSES

  • With BUY VIDEO the business buys, for 6 months from the day of payment, a non-exclusive right to use the video, including the influencer's face and voice as they appear in it, only for that product: in its own online ads (Facebook, Instagram, TikTok, Google), on its own social media pages and on its own website. It may shorten it and add subtitles, its logo and music it has licensed. Television, billboards and printed materials, selling or giving the video to others, using it for other products and altering the influencer's face, voice or words are not allowed. Copyright stays with the influencer and the video stays on the influencer's profile.
  • Prices by level: RISING STAR 2000 ALL, VIRAL 4000 ALL, ICON 6000 ALL. The price is set on our server from the influencer's level at the moment the payment starts. Video purchases are paid only by card through POK, to GETVIRAL, which pays the influencer their share, except for purchases and renewals paid after the influencer has requested the closure of their account, or after GETVIRAL has deleted their account, whose share belongs to GETVIRAL. The same business buys the same video once. After payment the business downloads a copy of the video file (MP4, up to 1080p, without the TikTok logo and without location data) and the "Licence of use" document with the licence dates. The file can be downloaded while the licence is valid.
  • 7 days before expiry the business receives a reminder. A renewal costs 50% of the purchase price and extends the licence by 6 months: from the expiry when renewed before it, from the day of payment when renewed after it. A video withdrawn after an upheld report can no longer be renewed. A video of an influencer whose account has been finally deleted can be renewed only before the licence expires. After expiry without renewal, the business removes the video from its ads and pages.
  • Within 7 days of payment, the business can report a video that is not for its product or whose file is not the same as the posted video. The influencer is notified. Only GETVIRAL staff decide: if the report is upheld, the licence is cancelled, the business stops using the video, the amount is refunded to the card used within 10 working days, the influencer's earning is not paid, and the video is withdrawn from sale. Until the decision, the influencer's earning from that sale is not paid. Otherwise the purchase is final and is not refunded, because the file is delivered immediately after payment.
  • When a report is upheld, the business sees under Purchased whether the refund is pending or done, and is notified when GETVIRAL has returned the amount to the card. If a payment arrives for a video that is no longer on sale, GETVIRAL opens a review automatically and staff decide, usually by refunding the business.
  • The business is responsible for its use of the video within the licence and for the ads in which it places it (the texts, claims and music it adds). Buying outside the platform the videos shown to it on GETVIRAL is prohibited.

10. Disclosure of paid content

Every post submitted to a campaign, and every post that promotes a product with your GETVIRAL link (the commission you earn is a payment), is paid content. It must be disclosed with the platform's official tool:

  • TikTok: turn on "Content disclosure" and choose "Branded content", which shows the "Paid partnership" label on the post. It can also be turned on after posting: "…" (More options) → "Ad settings".
  • Instagram: add the "Paid partnership" label when posting.
  • #ad, #reklame or similar hashtags do NOT replace the official label. They may only be added in addition to it.
  • A campaign post without the label visible is blocked and is not rewarded. Promoting products without the label is a violation of these terms.
  • Businesses and singers may not ask influencers to hide the collaboration, to leave out the label or to present the post as unpaid.
  • Without disclosure, TikTok and Instagram may limit the reach of the post or remove it.

11. Campaign hashtags

  • The business or singer sets up to 3 hashtags for each campaign. Staff review them together with the campaign.
  • Every campaign post must contain ALL the campaign's hashtags in its caption, spelled exactly as set.
  • The following are prohibited, in campaigns and in posts: misleading hashtags, hashtags that hide the advertising (such as #notsponsored or #notanad), hashtags that use someone else's brand without permission, hashtags that the platform bans or restricts.
  • A post that is missing a campaign hashtag or uses a prohibited one is blocked and is not rewarded.

12. Prohibited categories

The following categories are prohibited for campaigns and for the products offered with links on GETVIRAL. They follow the branded-content rules of TikTok and Instagram. TikTok allows some of them only through its own TikTok One programme, which GETVIRAL is not part of. Staff reject or remove any campaign or product in these categories:

  • Adult products
  • Live animals (their sale) and products from protected animal or plant species
  • Tobacco, nicotine, vapes, shisha and products that imitate smoking
  • Drugs and CBD
  • Weapons, explosives, fireworks, pepper spray
  • Alcohol (including alcohol-free drinks)
  • Energy drinks
  • Gambling, lotteries, real-money games, mystery boxes and games that resemble gambling
  • Financial services (loans, cards, insurance, investments, crypto), pyramid schemes/MLM, "payday" loans, get-rich-quick schemes
  • Medical institutions and treatments, medical devices, pharmacies, telemedicine, nutritionists, psychological therapy
  • Medicines (prescription or over-the-counter), vitamins, supplements and contraceptives
  • Weight loss (including detox and fasting), and content that promotes an unhealthy body image or an unhealthy relationship with food or exercise
  • Cosmetic clinics, cosmetic surgery, dental clinics, teeth whitening, hair growth, tattoos, laser treatments, cosmetics with medical claims
  • Formula and food for children under 2
  • Dating apps and live-video apps
  • Underwear, and film, TV-series or game trailers
  • Political advertising and government entities
  • Sensitive religious content
  • Professional services (legal, accounting, immigration)
  • Counterfeits, products that enable dishonest behaviour, and the sale of followers, likes or views
  • Content linked to sensitive events (death, disasters, attacks)
  • Hate symbols
  • Historical artefacts
  • Human organs and other human body parts
  • Subscriptions with automatic renewal
  • Any product or service that is illegal in Albania or Kosovo, and other highly controversial, distasteful, violent or dangerous products or services (e.g. hazardous chemicals, international bride agencies, prenatal sex determination)
  • Anything that violates the TikTok Community Guidelines or the Meta Community Standards

13. How posts are checked and views are counted

  • Every campaign post is checked automatically through the official API of TikTok or Instagram, with the account the influencer has connected for campaigns: that it belongs to the influencer and is public, that it was published after the campaign opened, how many views it has and, on TikTok, that its caption contains all the campaign hashtags. A post that the API shows as someone else's, not public or published before the campaign opened is not accepted (on Instagram: when it is not found among the connected account's posts published after the campaign opened). A post that passes these checks is approved automatically. GETVIRAL staff review only the posts that are flagged: when the API cannot verify the post (an account not connected on that network, a photo post, an API that does not respond), when hashtags are missing, when the views show an unusual pattern, when the 7 days are not confirmed, or when the business or singer files a complaint. Staff may reject a post, always with a stated reason. The official paid-partnership label, the instructions and the category and, in singers' campaigns, the use of the song are not shown by the official APIs: the influencer confirms that the post meets them when submitting it, and a post that does not meet them is not rewarded, even when this is found after automatic approval.
  • Businesses and singers do not reject posts. On their campaign page they see every submitted post and can file one complaint per post, choosing a reason. Only GETVIRAL staff decide: if the complaint is upheld, the post is blocked and not rewarded, and its reserved amount goes back to the campaign's budget (or becomes credit if the campaign has closed). If it is not upheld, the post stays valid. The influencer is notified and may send staff an explanation. Until the decision, the influencer's reward in that campaign is not paid. A complaint about a reward that has already been paid is not filed in the panel but at ankesa@getvir.al. Complaints that staff find baseless lower the Trust score of the business or singer.
  • Views are the number that the platform's official API returns for that post: on TikTok the post's view count, on Instagram the "views" metric, which counts organic views only. Views are updated daily until the final reading after the deadline: for TikTok posts it is made in the platform's first automatic run after the deadline. Instagram data can be delayed by up to 48 hours, so the final reading of Instagram posts is made 48 hours after the deadline. Views gained after the final reading are not counted. A post still awaiting staff review at the deadline is reviewed before the campaign closes, and once approved its reward is set by the views of the final reading. For a post from an account that is not connected, or whose connection has been interrupted, staff record the views.
  • The post must stay public for at least 7 days from its publication. These days are counted from the first moment the platform confirms the post is public: when it is submitted from a connected account and the official API finds it public, or when the first API reading or staff see it public, never from an earlier posting date. For a post from a connected account, the platform checks every day through the official API, until then, that the post still exists. A post deleted or made private before those 7 days is not rewarded: the influencer is told the reason, and the reserved amount goes back to the campaign's budget (or becomes credit if the campaign has closed). When the API cannot confirm it (for example the connection was interrupted), and for posts without proof from the API (from accounts that are not connected), staff check the post once the 7 days have passed, instead of it being rejected automatically. A reward is paid only after it has been confirmed that the post stayed public for 7 days: it is included in the monthly payout that follows the payout period in which the tier was reached, without waiting for the campaign to close. If the confirmation comes after that payout, the reward is included in the next one.
  • Purchased or artificially inflated views, and views that come from paying to promote the post itself, are not rewarded. Purchased or inflated views lead to forfeiture of the related rewards and to the measures of section 17, up to blocking the influencer's account. The amounts go back to the campaign's budget or, once it has closed, become credit of the business or singer that opened it.
  • Unusual view patterns are held for staff review before any reward is reserved: for example very few likes compared with the views (TikTok), a sudden jump in views several days after posting, or views far above the account's official follower count.

14. Referral programme

  • Every influencer has a personal referral link. When a new influencer account is opened through that link, and the invited person confirms their email and verifies at least one social network through the official connection, the referring influencer earns 100 ALL, provided the referring influencer's own account is verified. If it is not, the referral stays pending and the reward is granted automatically once the referring influencer is verified, as long as the invited person still meets the conditions. The reward is granted once per invited account. Only influencer accounts can be invited through the programme.
  • Referral rewards carry no platform fee. They are paid in lek together with the monthly influencer payout (1st–5th of the month), count towards the minimum payout of 5000 ALL and, below that minimum, carry over in full to the next month.
  • Until a reward is included in a monthly payout, including while it is carried over below the minimum payout, it is cancelled if the invited person deletes their account or their account is no longer verified. The referral is then shown as cancelled, with the reason, on the referrals page, and the referring influencer is notified. If the invited person verifies their account again before the reward is paid, the referral counts again, still with a single reward. A deleted account does not count again. A reward already included in a monthly payout is not affected by anything that happens afterwards, and a credited reward is not affected if the referring influencer later loses verification.
  • No reward is granted, and the referral is blocked automatically, when the new account is opened from a device that has already opened a GETVIRAL account, from the device with which the referring influencer registered, or from the same browser and internet connection as another referred registration. A shared internet connection on its own never blocks a referral.
  • GETVIRAL staff may review any referral: approve a blocked referral when the invited person is genuine, or block a referral found to be a self-referral or a fake account. Blocking cancels the unpaid reward of that referral. If you believe a referral was blocked wrongly, write to ankesa@getvir.al.
  • Creating accounts in order to collect referral rewards is a violation of these terms and is handled under "Measures in case of violations".

15. Trust score

Every account has a public Trust score from 1 to 10, which starts at 10.0 and changes according to the actions of the last 90 days: timely status updates, payments, rejections, confirmed complaints, complaints about campaign posts that staff find baseless, and staff corrections for confirmed violations (for example a campaign post without the paid-partnership label, or inflated views). Automatic reductions: 0.2 for an order accepted by oversight, 0.5 for a late invoice (once per block), 0.5 when an order is cancelled after a confirmed complaint, 0.3 when a rejection of yours is restored as accepted by staff, 1.0 for a confirmed attempt to communicate outside the platform, and 0.1 for an unanswered conversation. An acceptance marked automatically from Ultra's tracking page does not lower the Trust score. Staff restoring a rejection that this page marked automatically counts as a rejection of yours (0.3), because the business enters the tracking number. Every reduction is shown with its reason and can be contested at ankesa@getvir.al, and staff can reverse a reduction that was not justified. This score is visible to other parties on the platform.

Messages on the platform must be answered within 24 hours. We always notify you of new messages in the app and, within the daily email limit, by email (one email per conversation until you open it), and before every reduction we send you a warning by email. A conversation left unread and unanswered for more than 24 hours lowers the Trust score by 0.1 (at most 3 reductions per day), and opening the conversation within the deadline is enough. There is no reduction without a prior warning. In campaign conversations the duty to reply lies with the business or singer, while for customer questions it lies with the business. Messages are stored encrypted on our servers. Every conversation (with customers, between influencers and businesses, and about campaigns) is filtered automatically for attempts to move the contact outside the platform. GETVIRAL staff can read a conversation only when a message is flagged by the filter, reported or part of a complaint, and every such access is recorded. An attempt confirmed by staff lowers the Trust score by 1.0, and the sender may appeal to ankesa@getvir.al within 7 days.

16. Complaints

Complaints are filed from the platform (on the order concerned, with the COMPLAINT button on a campaign post, or with REPORT on a bought video) or at ankesa@getvir.al. GETVIRAL reviews them based on platform data, the Ultra tracking number and Ultra's public tracking page, and issues a decision within a reasonable time. After review, GETVIRAL may cancel an order, restore a wrongly rejected order, block a campaign post, cancel the licence of a video, or adjust an earning accordingly. A customer's complaint about the product, the delivery, a return or a refund is handled by the selling business: GETVIRAL may forward it and help. For any other matter (account, payments, technical questions) write to support@getvir.al.

17. Measures in case of violations

In case of violations, GETVIRAL may suspend or block the account, lower the Trust score, withhold payments related to the violation, and pursue legal remedies for damages caused or for the collection of unpaid obligations.

18. Personal data

How we collect, use, share and protect your data is described in full in the Privacy Policy, which forms part of these terms. In short: we collect only what is needed to run the platform, we never sell your data, the NIPT of a business is checked in the public QKB register, where the names of its administrators, partners and shareholders are only compared and never stored, the data of a customer who orders is passed only to the selling business, which gives Ultra only what the delivery needs, the original file of a video an influencer sells is given only to the business that buys it, and the data we receive from your connected TikTok/Instagram account through the official APIs is used only to verify your account, to account for and pay campaign rewards, to show you your own statistics and for the free-subscription threshold.

19. Age and legal capacity

  • Accounts may be opened only by persons 18 years or older with full legal capacity, or by minors acting through their legal representative.
  • Whoever registers a business declares that they have the right to represent it and that the NIPT or identity document and the address they give are true. The automatic check in the QKB register does not replace this declaration, and GETVIRAL may ask for proof of it at any time (section 4).

20. Intellectual property and content

  • The platform, the GETVIRAL name, its design and code are the property of GETVIRAL. Using an account grants you no rights over them.
  • The getvir.al domain and all its subdomains, including the shop addresses <name>.getvir.al, belong to GETVIRAL.
  • The content you upload (photos, videos, texts, sounds) remains yours. By uploading it, you grant GETVIRAL a non-exclusive licence to display it on the platform and in its promotional materials for as long as the content remains on the platform.
  • You warrant that you hold the rights to any content you upload. In their contract, singers declare that they own or control all the rights needed to use their songs and sounds in paid (branded) content, or that they have obtained written permission for this use. Any third-party claim is the uploader's responsibility.
  • Videos that influencers create for campaigns remain the influencer's. The business or singer gains the right to reshare them as defined in the campaign.
  • Videos that influencers sell (section 9) remain the influencer's: the business receives only the licence described there. The files of these videos are given only to the business that buys them, and GETVIRAL does not use them in its own promotional materials.

21. Limitation of liability

  • GETVIRAL is only an intermediary platform: we are not a party to the sale between the business and the customer and we do not guarantee product quality, description accuracy or delivery times — these are obligations of the selling business.
  • Returns, exchanges, warranties, refunds, refusals, delivery problems and every other issue towards the customer are handled by the selling business alone, under the consumer protection legislation of the Republic of Albania. The platform assists with complaints at ankesa@getvir.al and through the business's public Trust score.
  • Lost, damaged or delayed parcels and the amounts collected on delivery are handled by the business with Ultra, under its own contract with Ultra. GETVIRAL is not responsible for Ultra's service. If a customer or an authority turns to GETVIRAL about a business's products, deliveries or sales, the business takes the matter over and covers the costs it causes GETVIRAL.
  • The service is provided 'as is'. We do our utmost for high availability, but we are not liable for outages caused by force majeure, third-party infrastructure failures (including TikTok or Meta API changes or interruptions) or cyber attacks. In such cases you lose no earned entitlement (recorded earnings remain).
  • Our total liability towards a user is limited to the amounts (platform fees, campaign budgets and video purchases) that user has paid to the platform in the last 12 months.
  • Nothing in these terms limits liability that cannot be limited by law.

22. Termination

  • You may close your account at any time from your panel ('Delete my account'). Outstanding obligations (invoices to pay, payouts to receive) survive the closure and are settled under these terms.
  • While you still have orders in progress or unsettled obligations (an open order, an unpaid invoice, a sales fee not yet invoiced, an active campaign, a card payment in progress or a payout you are owed), the panel does not close the account: it closes once these are completed, or earlier on request at support@getvir.al. This protects the customer who is waiting for an order and the influencer who is waiting to be paid.
  • A request to close the account does not stop the payouts owed to the influencer: earnings that are or become payable after the request are paid with the monthly payout and its minimum, and the account is finally deleted after the last payout. If the account is reopened at the user's request, the closure request is cancelled.
  • GETVIRAL may suspend or close an account for violations of these terms, with notice where the circumstances allow it.

23. Governing law and disputes

  • These terms are governed by the legislation of the Republic of Albania.
  • We first try to resolve any dispute amicably via ankesa@getvir.al.
  • If unresolved, the competent court is the relevant court in Tirana, except where the law grants the consumer another mandatory forum.

24. Changes to these terms

These terms may be updated with 15 days' prior notice on the platform. Continued use after this period constitutes acceptance of the new terms. These terms are available in English and Albanian. Both versions have the same content.
