Terms of Service

1. What GETVIRAL is

GETVIRAL (app.getvir.al, getvir.al) is a platform operated by GETVIRAL, Tirana, Albania that connects Albanian businesses with content creators (influencers) and singers. Businesses publish products and set a commission for every unit sold; influencers pick products and promote them through a dedicated link. When a customer buys through that link, the sale is attributed to the influencer. Businesses and singers can also open campaigns in which influencers are rewarded according to the views of their posts.

GETVIRAL is an intermediary. The seller of the product is the business, which bears full responsibility for the product, its quality, delivery, and the fulfilment of its legal obligations towards the customer. By creating an account or placing an order you accept these terms.

2. Accounts and verification

  • Registration requires truthful information and an email address you control. The email must be verified before the first sign-in.
  • Influencers must prove ownership of their social profiles: either by temporarily placing a 5-letter code in their BIO (profiles must be public during verification), or by connecting the account through the platform's official login (TikTok Login Kit, Instagram Login).
  • One person or business keeps a single account. Duplicate accounts may be blocked.
  • After several consecutive failed attempts, sign-in is temporarily blocked and the wait grows with every further failure. The block expires on its own and is lifted immediately upon the first correct sign-in; the account is never closed for this.
  • You are responsible for keeping your password confidential and for every action taken from your account.

3. For businesses

  • Product information (price, description, photos and videos) must be truthful and kept up to date.
  • Shipping is ALWAYS free for the customer. The business includes the shipping cost in the product price.
  • A courier and a tracking number must be entered in the platform for every shipment.
  • The order status (Accepted or Rejected) must be updated within 72 hours of entering the tracking number.
  • The 'Rejected' status is only allowed for orders that have a tracking number and courier entered, so the customer's refusal can be verified with the courier.
  • If the status is not updated within the deadline, or if no tracking is entered within 5 days of the order, the order is automatically marked ACCEPTED and the commission is invoiced.
  • An order you believe to be fake or abusive must be reported through the platform (complaint on the order) before the deadline; GETVIRAL reviews it and may cancel it.
  • Customers may write to you through the platform chat before ordering. Communication with them stays INSIDE the platform; diverting them to external channels (Instagram, WhatsApp, Viber, etc.) is prohibited. Chats are filtered automatically and violations are reviewed by staff.
  • Businesses without physical products may register for promotion campaigns only (services, events, announcements). Physical products can be enabled later from the profile.

SALES FEE AND PRODUCT LIMIT

  • Registration and product listing are FREE; there is no monthly subscription and there are no plans.
  • The first 3 months from business registration are completely free: no platform fee on sales, no matter how many orders you receive.
  • After 3 months: 50 ALL (or 0.5 €) for every accepted order.
  • ONLY accepted orders are counted, by the date they were accepted. Rejected orders and orders not picked up by the customer are not charged.
  • Each currency is accounted for separately, with no conversions.
  • The commission the business sets for the influencer must be at least 10% of the product price.
  • The number of products has a technical limit; when you reach it, contact support from your panel to raise it.

4. For influencers

  • Registration is free if you have at least 1000 genuine followers on TikTok or Instagram.
  • Below this threshold the fee is 1000 ALL/month, payable in advance. It is removed automatically as soon as you reach the threshold and is never reinstated afterwards.
  • If the subscription is not renewed, you have a 5-day grace period; after that your links are deactivated and customers can no longer order through them.
  • Connecting your TikTok or Instagram account is voluntary. It is used only to verify ownership, count followers and verify campaign posts automatically; posts from non-connected accounts are verified by staff. GETVIRAL never posts or changes anything on your accounts.
  • You must comply with the terms and community guidelines of TikTok and Instagram, including labelling paid partnerships as those platforms require.
  • Creating fictitious orders — by yourself, relatives or third parties — is prohibited.
  • Manipulating follower counts or views through purchases or automated accounts is prohibited.
  • Promotion must be honest: no false promises and no untrue claims about the product.
  • You have no access to customers' personal data; you only see the product, the status and the tracking number.

5. Commissions and payments

GETVIRAL keeps 25% of the commission of every confirmed sale; the influencer receives the remainder. When an influencer reaches 30+ accepted orders in a month, the platform fee drops to 20% for that month. Commissions are displayed gross across the platform, while the EARNINGS panel also shows the net amount.

BILLING PERIOD

  • The business is invoiced every 2 weeks: commissions of the 1st–14th are invoiced on the 15th of the month; commissions from the 15th to the end of the month are invoiced on the 1st of the following month.
  • The invoice of the 1st also includes the sales fee for the month just closed (once per month).
  • Every invoice is payable within 5 days of generation (the 15th–19th and the 1st–5th respectively).
  • After the 5-day deadline passes without payment, the business profile and its products become UNAVAILABLE until the balance is settled.
  • Influencers are paid between the 1st and the 5th of the month for the period from the 25th of the previous month to the 24th (monthly cycle). Rewards from closed campaigns are included in the same payout.
  • Payout is made once earnings reach at least 5000 ALL or 50 € gross; below this amount, earnings carry over automatically to the next month.
  • Each currency has its own ledger: invoices and payouts in lek and in euro are kept separate, with no conversions between them.
  • Payout is made to the payment details declared in the profile. Without complete details, the payout is postponed until they are provided.

6. Orders and customers

Orders are placed with cash on delivery within Albania. Customer data is used only to fulfil the order and is shown only to the selling business and the platform administrator. Orders are subject to reasonable limits per device and phone number to prevent automated or fraudulent ordering.

7. Viral video campaigns

Businesses can open promotion campaigns (events, announcements, services) where influencers are rewarded according to the views their posts achieve. Opening campaigns carries no platform fee; the business pays only the influencers' rewards.

  • The campaign budget is PREPAID: the campaign becomes public only after GETVIRAL confirms the budget payment. The minimum budget is 30 000 ALL or 300 € (each currency separate, no conversions).
  • GETVIRAL holds the budget and distributes it to influencers who reach the thresholds. The campaign closes when its deadline passes or the budget is reached; the unspent portion at closing is returned to the business or kept as credit for the next campaign, as agreed with the business.
  • The business defines the reward tiers by views and a maximum budget; the reward is granted according to the highest tier the post reaches by the time the campaign closes.
  • The amount is reserved for the influencer the moment their post reaches a view threshold; when reserved amounts reach the budget, the campaign closes to new posts.
  • Each influencer may submit up to 3 posts per campaign. Posts from a connected account are verified automatically (ownership, posting date, the campaign hashtags and, for singers, the sound); unclear cases and signs of fraud are reviewed by GETVIRAL staff, who may reject posts with a stated reason.
  • The post must be marked as a paid partnership (e.g. #ad or the platform's corresponding label) and must remain published for at least 7 days after the campaign closes; deleted posts are not rewarded.
  • Views are read from the platforms' official APIs and updated daily. Unusually high view counts are held for review by staff before any reward is reserved. Purchased or artificially inflated views lead to closure of the influencer's account, forfeiture of the related rewards and return of the amounts to the business that opened the campaign.
  • Singers can also open campaigns for their own sounds (TikTok and Instagram only), under the same prepayment rules and minimum budget. By publishing a campaign, the singer declares that they hold the copyright to the song/sound and grants influencers permission to use it in campaign posts; any third-party claim over the rights is the singer's sole responsibility.

8. Trust score

Every account has a public Trust score from 1 to 10, which starts at 10.0 and changes according to the actions of the last 90 days: timely status updates, payments, rejections and confirmed complaints. This score is visible to other parties on the platform.

Messages on the platform must be answered within 24 hours. Messages left unread and unanswered lower the Trust score.

9. Complaints

Complaints are filed from the platform (on the order concerned) or at ankesa@getvir.al. GETVIRAL reviews them based on platform data and the postal tracking number, and issues a decision within a reasonable time. After review, GETVIRAL may cancel an order, restore a wrongly rejected order, or adjust an earning accordingly.

10. Measures in case of violations

In case of violations, GETVIRAL may: suspend or block the account, lower the Trust score, withhold payments related to the violation, and pursue legal remedies for damages caused or for the collection of unpaid obligations.

11. Personal data

How we collect, use, share and protect your data is described in full in the Privacy Policy, which forms part of these terms. In short: we collect only what is needed to run the platform, we never sell your data, the data of a customer who orders is passed only to the selling business and the courier, and the data we read from your connected TikTok/Instagram account is used only for verification and campaign accounting.

12. Age and legal capacity

  • Accounts may be opened only by persons 18 years or older, with full legal capacity.
  • Whoever registers a business declares that they have the right to represent it.

13. Intellectual property and content

  • The platform, the GETVIRAL name, its design and code are the property of GETVIRAL; using an account grants you no rights over them.
  • The content you upload (photos, videos, texts, sounds) remains yours. By uploading it, you grant GETVIRAL a non-exclusive licence to display it on the platform and in its promotional materials for as long as the content remains on the platform.
  • You warrant that you hold the rights to any content you upload. Singers declare copyright over their sounds in their contract; any third-party claim is the uploader's responsibility.
  • Videos that influencers create for campaigns remain the influencer's; the business or singer gains the right to reshare them as defined in the campaign.

14. Limitation of liability

  • GETVIRAL is an intermediary: we are not a party to the sale between the business and the customer and we do not guarantee product quality, description accuracy or delivery times — these are obligations of the selling business.
  • Returns, exchanges and warranties towards the customer are handled by the selling business under Albanian consumer protection legislation; the platform assists through its complaints system and the business's public Trust score.
  • The service is provided 'as is'. We do our utmost for high availability, but we are not liable for outages caused by force majeure, third-party infrastructure failures (including TikTok or Meta API changes or interruptions) or cyber attacks; in such cases you lose no earned entitlement (recorded earnings remain).
  • Our total liability towards a user is limited to the amount of fees that user has paid to the platform in the last 12 months.
  • Nothing in these terms limits liability that cannot be limited by law.

15. Termination

  • You may close your account at any time from your panel ('Delete my account'); outstanding obligations (invoices to pay, payouts to receive) survive the closure and are settled under these terms.
  • GETVIRAL may suspend or close an account for violations of these terms, with notice where the circumstances allow it.

16. Third-party platforms

GETVIRAL uses the official APIs of TikTok and Meta (Instagram) only with your authorisation and in compliance with their developer terms. GETVIRAL is an independent service and is not affiliated with, endorsed or sponsored by TikTok or Meta. Their services remain subject to their own terms.

17. Governing law and disputes

  • These terms are governed by the legislation of the Republic of Albania.
  • We first try to resolve any dispute amicably via support@getvir.al.
  • If unresolved, the competent court is the relevant court in Tirana, except where the law grants the consumer another mandatory forum.

18. Changes to these terms

These terms may be updated with 15 days' prior notice on the platform. Continued use after this period constitutes acceptance of the new terms. These terms are available in English and Albanian; both versions have the same content.
